Unlike a detached family home, buying a condominium means buying into a community. The following Rules have been approved by the Board of Directors of Kingswood on October 4, 2021 and are intended to make life in Kingswood congenial, safe, and enjoyable for all owners in the Kingswood Condominium Community.

These Rules are not meant to conflict with any of the Declarations and By-laws that govern the Kingswood Condominium Assoc., Inc. The Board reserves the right to amend these Rules and the fine structure associated with them by consent of the Board at any time. These Rules are to remain in effect until changes are approved by the governing Board.

PROHIBITED NUISANCE BEHAVIOR shall consist of the following:

  1. The following disorderly conduct is prohibited (This rule is adapted directly from the City of Albany Code):
    1. Fighting or quarreling in such a manner as to annoy or disturb the peace, quiet, comfort, or repose of any person in Kingswood; and
    2. Using any indecent, vulgar, obscene, threatening, or abusive language in Kingswood where other owners can hear; and
    3. Yelling, shouting, or making other loud noises by any means whether by voice, handclapping, or by other mechanical means in such a way as to annoy or disturb the peace, quiet, comfort, or repose of other Kingswood owners.
  2. Noise nuisances are prohibited on the property of Kingswood. No owner or occupant of a condo may create loud noises that can be heard beyond the outside walls of their unit between the hours of 9 PM and 7 AM. Additionally, no owner or occupant shall engage in any noise nuisance at Kingswood during any time of the day or night, including but not limited to the honking of horns, revving of engines, and riding loud vehicles such as motorcycles.
  3. Encroaching on the assigned parking space or spaces of another owner is prohibited.
  4. Repairing or working on vehicles or other equipment on Kingswood grounds is not allowed. Do not work on your car, boat, trailer, or other vehicles in front of or behind your condo. Washing of cars on the property is allowed in a spot reserved for the same at the northwest corner of the fenced-in pool area.
  5. Dogs should not be allowed to roam on the property of Kingswood without supervision. Leashes are required on the dogs at all times, and pickup of pet litter is mandatory. Pets are allowed provided they do not endanger the health or, in the sole discretion of the Board of Directors, unreasonably disturb the owner or occupant of any residence
  6. Creating an eyesore objectionable to other owners is not allowed. For example, do not leave trash containers, old furniture, or tires outside of your unit or anywhere on our grounds so that neighbors can see the same.
  7. Misuse of the shared common trash dumpster is prohibited. Only household garbage is to be disposed of in the common trash dumpster. Large boxes must be broken down and flattened. No furniture, appliances, carpet, nor maintenance/construction debris may be placed in the common dumpster
  8. Speeding in a vehicle above the posted speed limit of 10 MPH is prohibited at all times on Kingswood grounds.
  9. Please do not drive heavy vehicles like cars and trucks on grassy areas. There are sprinkler lines and other utility lines that can be damaged by heavy traffic. Also, inform maintenance people and contractors doing work around your Unit. (Added January 2022).

Assessment of Fines:

The Kingswood Condominium Association, Inc. does not have a policing force, nor does it have a desire for one. Owners are expected to comply with the Rules as set forth in our By-Laws and Declarations, as well as the Rules set by the Board of Directors herein.

The Board’s responsibility is to oversee and enforce the Rules and help provide an amiable place for its Owners to live. The Board will notify the owner or occupant of Kingswood who violates the Rules, By-Laws or Declarations when two (2) or more owners or occupants report a complaint about the behavior of another owner to the Board.

When two (2) or more nuisance behavior complaints are reported, the Board will:

  1. Notify the errant owner or occupant of the prohibited nuisance behavior and demand the owner or occupant cease said behavior. Notification may be delivered by email, letter, or in person.
  2. On the next subsequent occurrence of the same nuisance behavior (after notification and demand to cease) within a six-month period, the owner will be fined by the Board in the amount of $50, which fine may be enforced by the placement of a lien on the owner’s property and/or seeking an injunction against the violator.
  3. On subsequent repeats of the same nuisance behavior thereafter, the owner will be assessed a fine of $100 for each occurrence, which fine may also be enforced by the placement of a lien on the owner’s property and/or seeking an injunction against the violator.
  4. To the extent that the Board is required to hire an attorney to file a lien or seek an injunction against the owner or occupant who is in violation of the Rules, Declaration or By-laws, the owner or occupant shall be liable to the Board for the attorney’s fees incurred by the Board in the enforcement of the Rules, Declaration or By-Laws.
